Justin Fairfax accuser told congressman about alleged assault over a year ago

Fairfax forcefully denied Tyson's allegations, writing in a statement posted to Twitter on Wednesday that the encounter was consensual. An aide to Congressman Scott confirmed to CBS News that Tyson first approached him about the alleged encounter while the Washington Post was investigating her claims past year.

A source working with Tyson's legal team, Ford's former counsel firm Katz Marshall and Banks, tells CNN that Tyson "has retained and is consulting with her legal team about next steps".

Lieutenant Governor Justin Fairfax has been accused by a woman of sexual assault - an allegation he denies, saying it had been a "100 per cent consensual" encounter.

In a November 29 email, Tyson expressed her dislike for Fairfax and wrote that she would like to "talk about it", with Congressman Scott.

Since the #MeToo movement emerged, Tyson has been frequently quoted as an expert about the intersection of politics and sexual assault and harassment claims, including the allegations by multiple women that triggered the 2017 resignation of Sen.

In a text message exchange between Scott and Tyson in December 2017, she informed him that the now-Lieutenant Governor-Elect had a "MeToo allegation", but at the time the congressman did not know that she was the accuser, according to aides. The silence of the left (in the Fairfax case) speaks volumes. "She deserves the opportunity to have her story heard". Instead, the Washington Post reports, he is considering leaving the party.

In a lengthy statement released on earlier on Wednesday, Tyson recounted the alleged incident with Fairfax in detail. He has since refused to resign, despite growing calls to do so.

Vanessa Tyson said in a statement that she came forward with her sexual assault allegation in part because of the possibility that Fairfax could succeed a scandal-mired governor.

"I can not believe, given my obvious distress, that Mr. Fairfax thought this forced sexual act was consensual", Tyson wrote.

The editorial continued, noting that many questions concerning this scandal remain.

"I only know from my experiences what it's like to be treated differently because I'm female or because I'm bisexual", the governor told reporters sitting with her at a conference table in her office. They released a joint statement calling for an investigation into Fairfax and urging Herring to continue to be "engaged in in-depth discussions with leaders and others in Virginia ... if he is to regain (the public's) trust".

Aside from significant concerns about his judicial record, Judge Kavanaugh's appearance last week before the Senate Judiciary Committee demonstrated that he lacks both the judicial temperament and impartiality required of judges who sit on any court of law, especially the United States Supreme Court.

"While this allegation has been both surprising and hurtful, I also recognize that no one makes charges of this kind lightly, and I take it and this situation very seriously", Fairfax wrote. While Fairfax has asked for his family and Tyson's family to be respected and given privacy, he has continually stuck to his initial statement that he has nothing to hide.

"I think there's a rightful hesitation about removal from office because, obviously, you have to consider that to some degree you're overturning an election", the Times-Dispatch quoted Cox as saying Monday.
