But the heart-warming campaign hasn't had the happy ending many hoped for, with ex-soldier Mr Bobbitt, 34, saying that Ms McClure and her partner, Mark D'Amico, 35, won't give him his money.

The judge ordered that the money be removed from McClure and D'Amico's bank accounts, and placed in a third-party escrow fund until the case concludes.

"He's homeless and penniless", Promislo said about Bobbitt.

Burlington County Judge Paula Dow granted the restraining order pending a preliminary injunction hearing on September 14.

That good deed, however, evolved into a legal dispute when Bobbitt accused the couple of spending the money on themselves and using it to make purchases for Bobbitt without giving him the money raised in his name.

The couple denied claims the money was being held back on goal. To thank him for his generosity, McClure set up a GoFundMe page and encouraged people to donate so Bobbitt would no longer have to live on the streets.

The couple said this week on NBC's "Megyn Kelly Today" that there was "well over" $150,000 of the money remaining.

"The idea my clients are the bad guys.is completely not true", Ernest E. Badway said, according to the Philadelphia Inquirer.

D'Amico and McClure deny the allegations, arguing they are wary of handing the army veteran large sums as they fear he will buy drugs.

"He's really left us with no choice but to go forward".

According to the GoFundMe page, however, McClure wrote that a home, not a camper, would be bought for Bobbit. But, Bobbitt did not have an attorney or financial adviser at the time, Fallon said. On Wednesday, he said he and McClure had opened up a separate account for Bobbitt.

GoFundMe was also investigating the claim of misappropriation of the funds from the drive. The remainder of the money is one of their accounts, Badway said. He was very successful at a methadone clinic before, she said.

But the sweet story turned bitter, with Bobbitt claiming the couple was withholding his funds.

But, Dow ordered that the money be given to Bobbitt's attorneys before Labor Day. That money will be put into a trust.

D'Amico and McClure could not be immediately reached for comment. "When you see it, the numbers that we're talking about are not that far off". He said he paid it back with money he won.

He is now "hopeful" and "optimistic" as he completes another stint in rehab, Fallon said.

Some of the money went to GoFundme administrative fees. On Thursday morning he said he told a reporter the trusts had been set up because that's what Bobbitt wanted him to say.
