Brett Kavanaugh memo detailed explicit questions for Clinton

'The question is, if Monica Lewinsky says that while you were in the Oval Office area you touched her breasts would she be lying?' Clinton got asked, in what looks like a version of Kavanaugh's questions.

- Brett Kavanaugh, in a 1998 memo to Ken Starr released in response to a Washington Post Freedom of Information Act request, suggesting questions that the Independent Counsel should ask of the then-sitting president.

He further wanted to ask the president: 'If Monica Lewinsky says that you inserted a cigar into her vagina while you were in the Oval Office area, would she be lying?'

"I am strongly opposed to giving the President any "break" in the questioning regarding the details of the Lewinsky relationship", Kavanaugh implored, unless he "resigns" or "confesses perjury", Kavanaugh added.

In the 2009 law review article, Kavanaugh wrote, "Congress might consider a law exempting a President-while in office-from criminal prosecution and investigation, including from questioning by criminal prosecutors or defense counsel".

When Clinton was questioned by the independent counsel, Starr's attorneys did cover much of what Kavanaugh suggested, though their wording was not exactly the same.

Mr. Schumer said Republicans are keeping some documents from Judge Kavanaugh's time in the Bush White House secret because they've been marked as confidential by lawyers for former President George W. Bush.

"The president has disgraced his office, the legal system, and the American people by having sex with a 22-year-old intern and turning her life into a shambles - callous and disgusting behavior that has somehow gotten lost in the shuffle", Kavanaugh wrote. "He has tried to disgrace you and this Office with a sustained propaganda campaign that would make Nixon blush".

Donnelly and Manchin also signaled that they would make up their mind on Kavanaugh following his Senate hearing; Manchin said the two had a "very productive" meeting, but he would meet with Kavanaugh again after his Senate hearing.

Mr. Bush's presidential library is reviewing and turning over to the committee documents related to Judge Kavanaugh's work in the White House counsel's office from 2001 to 2003. It reveals a hardball tactician who argued forcefully that Starr had the right to press the president for answers, a view he later shifted, saying presidents are too busy to be subject to such investigations while in office.

"I personally regret how that report was released because I think it was - parts of it that were released were unnecessary to be in the public domain", Kavanaugh said.

"Like many Americans at that time, I believed that the President should be required to shoulder the same obligations that we all carry", he wrote. Senate Majority Leader Mitch McConnell has said he hopes Kavanaugh will be confirmed to replace retired Justice Anthony Kennedy before the new session begins in October.
