Countering the plaintiffs' arguments against the program's termination, the Trump administration said the plaintiffs did not have legal standing, and that the court lacks jurisdiction over the case.

About 700 thousand young undocumented immigrants have signed up for the DACA program since the Obama administration established it.

Last Sept. 5, DHS announced that it would no longer accept new applications for DACA and begin letting renewals expire after March.

The federal judge noted that the Department of Homeland Security canceled DACA, alleging that the immigration protection program is "illegal", but said it did so without explaining how it came to that conclusion. Politico reported that he is the first Republican-appointed judge to rule this way on DACA. That deportation deferrance can be renewed indefinitely, effectively allowing once-illegal and still-illegal immigrants in the U.S.to live here without struggle. If it doesn't, the judge ruled that the program would have to stay in place and the Department of Homeland Security would be required to accept new applications.

Justice Department spokesman Devin O'Malley said in a statement that the Trump administration's legal position on DACA is solid.

No one who is thinking rationally - or who has a heart - believes it makes any sense at all to treat someone who'd been brought here as a child as some sort of a criminal.

"For those that are DACA eligible but never applied: Unfortunately, No new applications are being accepted", she wrote.
